do I need an attorney for my personal injury claim

THE FINE PRINT: The information provided on this website is opinion and general legal information about the laws in North Carolina. It is not intended to provide legal advice and does not create an attorney-client relationship.

One of the first questions people often ask me is whether they need an attorney for an accident claim. The answer generally depends on how serious your claim is. Just as you would not go to a doctor for a scrape on your elbow, you will probably not need a lawyer if you’ve been in a fender-bender in which no one was injured. On the other hand, if you have a serious injury like a broken bone, ruptured disc, or brain injury, you should consult a lawyer.

It is those situations in between very minor injuries and very serious injuries where you will have to make a judgment call. In those in-between situations, the best thing to do is call a lawyer and ask the lawyer whether he or she would be able to get a significantly better result than you are able to get on your own. In order to do that, you should have some idea about the cost of repairing your vehicle, the nature of your injuries, the total amount of medical bills and lost wages, and whether your injury is expected to heal completely or to be a problem for the rest of your life.

Another important thing to know about that is, that it is not legal for an insurance adjuster in North Carolina to discourage you from getting a lawyer when you’ve been in a wreck. If an adjuster tries to persuade you not to get a lawyer, you should take a step back and consider what the adjuster’s motives are. Are they trying to put more money in your pocket or to save money for the insurance company?

If you are not sure whether you want or need a lawyer, you can give me a call. I won’t charge you anything just to talk on the phone, and I’ll try and help you sort things out. I’ll help you figure out whether you can expect to come out ahead with a lawyer. You may think that this is like asking the fox to guard the henhouse, but I have been doing this for a long time, and my goal is for people to feel that they are better off with my help. Also, since I am in private practice and not part of a mega-firm, I have to limit the number of cases that I take. So, if you don’t need a lawyer, I’ll be happy to tell you so, and can refer you to specific videos in this series that might help you.

The most important thing is to not let the insurance company take advantage of you, which is why I have put these videos together.
